Inkia Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Inkia mobile application and related services provided by [COMPANY LEGAL NAME] ("Inkia," "we," "us," or "our"). By creating an account, downloading, installing, or using Inkia, you agree to these Terms, the Inkia Privacy Policy, and the Inkia End User License Agreement (EULA).
1. Eligibility
You must be at least eighteen (18) years old, or the age of majority in your jurisdiction, whichever is higher, to use Inkia. Inkia is not directed to children. You represent that you meet this requirement and that you are legally able to enter these Terms.
2. The Service
Inkia is an AI-assisted immersive interactive story service. The Service presents publisher-created stories, worlds, characters, and scenarios. You may enter a story and interact with AI-assisted characters and narrative systems to progress a story session. Inkia is entertainment and does not provide professional, medical, legal, financial, or other expert advice.
3. Accounts and Security
You are responsible for providing accurate information, maintaining access to your account, and keeping authentication credentials secure. You may not share, sell, or transfer your account. Notify us promptly if you believe your account has been compromised.
4. AI-Generated Content
Story text, character responses, narrative developments, and other outputs may be generated or enhanced by AI. AI output may be inaccurate, inconsistent, offensive, or unsuitable, and may not reflect Inkia’s views. Do not rely on AI output as factual or professional advice. We may monitor, filter, modify, limit, or remove outputs to operate the Service and protect users.
5. Prohibited Conduct
Use Inkia if you do not meet the age requirement.
Use the Service for unlawful, fraudulent, abusive, harassing, exploitative, or harmful activity.
Attempt to bypass age controls, content controls, payment controls, or technical protections.
Reverse engineer, decompile, scrape, probe, or interfere with the Service or its underlying systems.
Use automated means to access or collect content except as authorized by us.
Upload, transmit, or induce content that infringes rights, contains malware, or is intended to facilitate wrongdoing.
Misrepresent your identity or use another person’s account.
6. Purchases and Payments
Inkia may offer one-time in-app purchases, including access to specified stories, chapters, features, or virtual entitlements. Prices and purchase terms are shown at the point of purchase. Payments are processed by the applicable app store. Purchases are generally non-refundable except as required by law or the applicable store’s policies. Purchased entitlements are personal, non-transferable, have no cash value, and may not be sold or exchanged. Account deletion may permanently remove access to entitlements associated with the deleted account after the thirty (30)-day recovery period ends.
7. Intellectual Property
The Service, including its software, design, stories, characters, text, artwork, audio, trademarks, and other materials, is owned by or licensed to Inkia and protected by law. Except for the limited rights granted in the EULA, no rights are transferred to you.
8. Suspension and Termination
We may suspend or terminate access if you violate these Terms, create risk, engage in abuse or fraud, fail to pay, or where necessary to comply with law or protect the Service. You may stop using Inkia at any time. Termination does not eliminate obligations that by their nature should survive, including intellectual property, disclaimers, limitations of liability, and dispute provisions.
9. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT WARRANT THAT THE SERVICE OR AI OUTPUT WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, ACCURATE, OR AVAILABLE AT ALL TIMES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INKIA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, GOODWILL, OR CONTENT ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO INKIA FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS, EXCEPT WHERE LAW DOES NOT PERMIT THIS LIMITATION.
11. Changes to the Service or Terms
We may modify, suspend, or discontinue features, stories, or the Service. We may update these Terms by posting a revised version. Continued use after the effective date means you accept the revised Terms, except where applicable law requires additional consent.
12. Governing Law and Contact
